Brokerage relationship disclosure
Florida law requires real estate licensees to operate as one of the following relationships with a buyer or seller in a residential transaction:
- Transaction Broker — provides limited representation to a buyer, seller, or both without acting as a fiduciary. This is the default relationship under Florida law unless otherwise agreed in writing.
- Single Agent — represents either the buyer or the seller, but not both in the same transaction, with full fiduciary duties.
- No Brokerage Relationship — the licensee owes the customer only certain limited statutory duties.
Commercial transactions (4 or more residential units, or any non-residential property) are not subject to the mandatory disclosure statute, but we still document the brokerage relationship in writing for clarity at the start of every engagement.
